Terms of Service

Welcome to JessTools. These Terms of Service ("Terms") govern your use of the JessTools website and your purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not use our website or services.
1. Account Creation and Responsibilities
You may be required to create an account to access certain features or expedite the checkout process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. JessTools reserves the right to terminate accounts, remove or edit content, or cancel orders at our sole discretion if we suspect fraudulent or abusive behavior.
2. Payment and Billing Terms
We accept the following forms of payment: Visa, Mastercard, American Express, PayPal, Wire Transfers, Cash, and Check.
When you place an order using a credit or debit card, a temporary authorization hold may be placed on your account to verify funds. However, your card is not officially charged until your item is prepared and leaves our facility for shipment. For Wire Transfers, Cash, and Check payments, orders will only be processed and shipped once the funds have completely cleared our financial institution.
3. Pricing and Typographical Errors
All prices are listed in US Dollars. We strive for complete accuracy in our pricing and product descriptions; however, errors may occasionally occur. In the event that a product is listed at an incorrect price due to a typographical error, JessTools reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your payment method charged. If your payment method has already been charged and your order is canceled, JessTools will immediately issue a full refund to your original payment method.
4. Shipping, Delivery, and Risk of Loss
Geographical Restrictions: Standard shipping is available exclusively to the contiguous lower 48 United States. Shipping to Alaska, Hawaii, US Territories, Canada, and other international destinations is not available through standard checkout and requires a special order quote. Please contact us directly for freight quotes outside the lower 48 states. We cannot deliver heavy machinery to P.O. Boxes.
Risk of Loss: All items purchased from JessTools are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the equipment to the LTL freight carrier. Once the carrier takes possession of the crate at our facility, the buyer and the carrier's insurance assume full responsibility for any damage or loss that occurs in transit.
5. Refused Deliveries
If you refuse a freight delivery at your location for any reason other than documented transit damage, you are considered responsible for the transaction. The buyer will be held strictly liable for the original outbound shipping costs, the return shipping costs to get the machinery back to JessTools, and a 15% restocking fee. These costs will be deducted from your final refund.
6. Warranties
As the manufacturer of our equipment, JessTools stands behind the craftsmanship of our products. We provide our own direct manufacturer’s warranty on JessTools equipment. 7. Limitation of Liability
Heavy equipment and industrial tools carry inherent risks. By purchasing from JessTools, you agree that you are appropriately trained and qualified to operate the machinery.
To the fullest extent permitted by law, JessTools shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or in connection with the use or inability to use our products. This includes, but is not limited to, lost job-site profits, operational downtime, property damage, or personal injury resulting from the use, misuse, or alteration of the equipment. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you for the specific product causing the liability.
8. Governing Law
These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal disputes arising from these Terms or your purchase must be resolved exclusively in the state or federal courts located in Missouri.
